SurveyScribe (the app) is provided by Nexus Versa Ltd, a company registered in England and Wales, of Silverstream House, 45 Fitzroy Street, London W1T 6EB (we, us). By installing or using the app you agree to these terms.

1. The app

SurveyScribe helps you record a site, property or asset survey and produce a report from it. It is a recording and report writing tool. It does not inspect anything, does not make findings, and does not replace the judgement of a suitably qualified person. You are responsible for the accuracy and content of every record and every report you issue, and for complying with any professional, statutory or contractual obligations that apply to your work.

2. Your data

Everything you record in the app is stored on your own device. We do not have access to it. Our privacy notice at surveyscribe.co.uk/privacy explains what the app does with your data and what we collect, which is very little. You are responsible for keeping backups, for example by sharing site files to another device, and for the lawful handling of any personal data (such as photographs of people) that you capture.

3. Free and Pro

The free version lets you record without limit and issue up to three reports, each marked "Made with SurveyScribe Free". SurveyScribe Pro removes that limit and the marking and includes expansion packs, as described in the app at the time of purchase.

Pro is an auto-renewing subscription bought through Apple's App Store or Google Play. Payment is taken by the store at confirmation of purchase and at the start of each renewal period unless you cancel at least 24 hours before the period ends. You manage and cancel the subscription in your App Store or Google Play account settings; deleting the app does not cancel it. Refunds are handled by the store under its own rules. Prices are shown in the app in your local currency and may change; a change applies from your next renewal and you will be told in advance.

The monthly plan includes one expansion pack of your choice, which you may change once every 30 days. The annual plan includes every expansion pack available during the subscription period. Sites made with a pack keep that pack's statuses, tags and wording after the subscription ends; you will still be able to open, edit and export them.

4. Expansion packs

Expansion packs supply statuses, tags and report wording for a kind of survey. Where a pack refers to a published standard or guidance, that is for your convenience. We do not warrant that a pack reflects the current version of any standard, and nothing in a pack is professional advice. Check the guidance that applies to your work.

5. Licence

We grant you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, subject to these terms and the rules of the store you obtained it from. You may not copy, modify, reverse engineer, resell or lend the app, or use it to build a competing product. Reports you create are yours.

6. Availability and changes

We may update, change or withdraw features, packs or the app itself. We will not remove your ability to open and export the sites on your device for as long as you have a version of the app that runs on your device. We do not promise that the app will be free of faults or available at all times.

7. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, we are not liable for any loss of profit, business, contracts, data or goodwill, or for any indirect or consequential loss, arising from your use of the app or from any report produced with it. Our total liability to you in connection with the app is limited to the amount you paid us for it in the twelve months before the claim arose. The app is provided as is, and, to the extent the law allows, without warranties of any kind.

8. Apple and Google

If you obtained the app from Apple's App Store, Apple is not a party to these terms, has no obligation to provide maintenance or support, and is not responsible for any claim relating to the app; Apple is a third party beneficiary of these terms and may enforce them against you. The equivalent applies to Google for Google Play. You confirm that you are not in a country subject to a US government embargo and are not on any US government list of prohibited parties.

9. General

These terms are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction. If any part of these terms is found unenforceable, the rest stands. We may update these terms; the date at the top shows the current version, and continuing to use the app after a change means you accept it.
